General Terms and Conditions (GTC) for Events and Tickets

1. Scope and Conclusion of Contract
These General Terms and Conditions apply to attendance at and the purchase of tickets for events conducted or organized by MACC Management GmbH (“Organizer”).
The contract for the purchase of a ticket is concluded between the purchaser and the Organizer. Tickets may be sold through distribution partners commissioned by the Organizer. The General Terms and Conditions of the respective distribution partner may also apply to the processing of the ticket purchase.
In the event of any conflict between these Terms and Conditions and the terms of the distribution partner, these Terms and Conditions shall generally govern the relationship regarding the event; mandatory statutory provisions remain unaffected.
The ticket price is due for payment upon conclusion of the contract. The ticket entitles the holder to attend the event only after full payment has been made.

2. Admission, Age Restrictions, and Discounted Tickets
Admission to an event may be subject to a minimum age requirement. The applicable age and admission regulations will be announced for each event.
For children and adolescents, the statutory provisions apply, in particular the provisions of the Youth Protection Act. In addition, event-specific admission regulations may apply.
For discounted tickets, the reason for the discount must still apply at the time of the event and must be verified upon request. If proof cannot be provided, admission may be contingent upon payment of the difference between the discounted price and the regular ticket price.
The organizer is entitled to deny admission if the requirements for ticket purchase or admission are not met.

3. Transfer and Resale of Tickets
Tickets may generally be transferred to other persons, provided that the respective event does not stipulate any differing rules, particularly those applicable to personalized tickets.
Commercial or abusive resale—particularly for the purpose of making a profit or through unauthorized ticket platforms—may be prohibited.
For personalized tickets, transfer is only permitted to the extent allowed by the terms and conditions applicable to the respective event.
The organizer is entitled to block tickets that were purchased or resold in violation of these terms and conditions, to the extent permitted by law.

4. Cancellation, Rescheduling, and Changes to the Event
The organizer is entitled to cancel, reschedule, or make changes to the event’s program for objectively justified reasons, in particular due to force majeure, official orders, safety concerns, illness of performers, or similar circumstances.
In the event of a rescheduling, tickets generally remain valid for the alternate date. If the organizer provides for a return option for the event in question or if a refund is required by law, information regarding the procedure and applicable deadlines will be provided in a timely manner.
In the event of a permanent cancellation, the ticket price will be refunded in accordance with legal requirements and the refund conditions applicable to the respective event.
Any further claims remain unaffected to the extent they are provided for by law.
Travel, lodging, or other incidental expenses will generally not be reimbursed unless the organizer is responsible for their occurrence and no mandatory legal claims preclude such reimbursement.

5. Liability and Event Schedule
The organizer bears unlimited liability for damages resulting from injury to life, limb, or health, as well as for damages caused by willful misconduct or gross negligence on the part of the organizer, its legal representatives, or its agents.
In the event of a breach of material contractual obligations due to slight negligence, the organizer is liable only for foreseeable damages typical for this type of contract.
In all other respects, the organizer’s liability is excluded to the extent permitted by law.
The organizer is entitled to make reasonable changes to the event schedule for organizational, technical, safety-related, or artistic reasons. Changes to the program or the lineup generally do not entitle the attendee to a refund, provided that such changes do not materially impair the contractual purpose of the event.

6. Seating and Admission
The organizer is entitled to reassign seats or seating locations for organizational or safety reasons.
Provided that an equivalent seat within the same price category is offered, this generally gives rise to no further claims.
If a seat in a lower price category is assigned, the corresponding price difference will be refunded.
The organizer may deny admission for safety reasons or in the event of violations of these Terms and Conditions or the house rules, or may exclude a visitor from the event.
In such cases, a claim for a refund of the ticket price exists only to the extent required by law.

7. Prohibited Items and Conduct on the Event Grounds
In particular, weapons, dangerous items, pyrotechnic devices, glass containers, and items that can be used as projectiles are prohibited on the event grounds.
Other items, particularly large bags, backpacks, or other objects, may be prohibited depending on the specific event. The applicable security regulations will be announced before or, at the latest, upon entry.
Visitors must follow the instructions of the organizer, security personnel, and event staff.
In the event of significant or repeated violations, the visitor may be excluded from the event and removed from the event grounds without entitlement to a refund of the ticket price, to the extent permitted by law.

8. Photographs, Films, Audio Recordings, and Other Recordings
The creation of professional photographs, films, or audio recordings, as well as recordings for commercial purposes, generally requires the prior consent of the organizer.
Private photographs and video recordings may be permitted or restricted in accordance with the rules of the respective event. Relevant notices must be observed.
During the event, the organizer or third parties commissioned by the organizer may take photographs, film, or make audio recordings.
To the extent that visitors appear in such recordings merely as part of a larger group, as part of the audience, or as other unavoidable incidental elements of an event recording, such recordings may be published in accordance with applicable legal provisions.
For recordings in which individual visitors are specifically and individually depicted, the applicable legal requirements for consent and information apply.

9. Data Protection, House Rules, and Applicable Law
Personal data is processed in compliance with applicable data protection regulations. Details are set forth in the applicable privacy notices of the organizer and, where applicable, the ticket sales partner.
Supplementary house rules or event regulations may apply to the event. These will be made available to visitors in an appropriate manner and form an integral part of the conditions of admission.
The laws of the Federal Republic of Germany apply. Mandatory consumer protection regulations of the country in which the consumer has his or her habitual residence remain unaffected.

10. Cancellation, Final Provisions, and Dispute Resolution
For tickets to events with a specific date or time period, there is generally no statutory right of cancellation under Section 312g(2)(9) of the German Civil Code (BGB).
Therefore, the return or exchange of tickets is generally excluded, unless the organizer offers a voluntary return option or a statutory right to a refund exists.
Should individual provisions of these General Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provisions.
For consumers, the statutory places of jurisdiction apply. Any deviating agreement on the place of jurisdiction is valid only to the extent permitted by law.
The organizer is not obligated and, to the extent permitted by law, is not willing to participate in dispute resolution proceedings before a consumer arbitration board.
